I received a letter from the FDA telling me that my e-liquid shipment would be
Either destroyed or sent back. The bothersome part is the last paragraph of the letter as follows:

…”These products must be exported or destroyed under Customs supervision within 90 days
From the date of this notice, or within such additional time as the District Director of Customs specifies.
Failure to do so may result in destruction of the products. Distribution of the products may result in
Their seizure and/or injunction or Criminal Prosecution of persons responsible for their distribution
.”


Now I am assuming (I hope) that they are only talking about this held package!?
Still gives me Goosebumps though!
The US Customs contact wrote on the letter “Proof of Export received. No further action needed, This case is closed.”
So I believe they are sending them back to the wholesaler as I requested. At least they will get their 250 bottles of e-liquid and 1 atomizer back.
The reason for the refusal of admission states:
FPLA Section 4(a); 801(a)(3) Misbranding
“The article appears in violation of FPLA because of its placement, form and/or contents statement.”
This applies to both the e-liquids and the atomizer.

The FDA Compliance Officer’s contact information is below, in case anyone wants to write or email him.
I have emailed him for a more concrete definition on this and the law, so I will let you know what he says.

All of the importers need to do one thing to get your shipments.. HAVE THE SELLER put cell phone or PC parts on the customes slip.. thats how I do it and there is no problems....
